Air Porter International® – Charter Terms & Conditions
Effective Date: 09 December 2025
By using Air Porter International® services, including browsing our website, requesting quotes, or booking flights, you agree to the following Terms & Conditions.
1. Our Role
1.1 Air Porter International® is a private charter broker. We act as an intermediary between clients and licensed air operators (“Operators”) to arrange private charter flights.
1.2 We do not own or operate aircraft. All flights are provided by fully certified operators who:
(a) Comply with Civil Aviation Safety Authority (CASA) regulations;
(b) Hold valid Air Operator Certificates (AOC);
(c) Maintain all legally required safety, operational, and insurance standards.
1.3 Our role includes:
(a) Sourcing suitable aircraft and operators for your requested itinerary;
(b) Providing accurate pricing and availability information;
(c) Coordinating optional services such as catering, ground transportation, or VIP handling.
1.4 We are not responsible for:
(a) The operation, maintenance, or safety of the aircraft;
(b) Delays, cancellations, or operational issues caused by the operator or external factors.
2. Quotes, Booking & Confirmation
2.1 All quotes provided are indicative and subject to aircraft, crew, and operational availability.
2.2 Bookings are only confirmed once you receive a written confirmation from Air Porter International that includes:
(a) Aircraft type and registration (if available);
(b) Detailed itinerary;
(c) Price breakdown, including optional extras;
(d) Payment terms and schedule.
2.3 Until confirmation and any required deposit/payment are received, the quoted aircraft is not reserved, and the quote may be withdrawn or updated.
2.4 Alternative aircraft may be proposed if the originally requested aircraft is unavailable. Any alternative will be of similar or higher standard.
2.5 Confirmation is binding only for the dates, times, and itinerary specified. Changes outside the agreed schedule require operator approval and may incur additional costs.
3. Pricing & Payment
3.1 The confirmed Charter Price includes:
(a) Aircraft hire and crew;
(b) Fuel for the planned itinerary;
(c) Standard landing, handling, and parking fees;
(d) Standard operating costs such as insurance, maintenance, and crew expenses.
3.2 Optional services, including but not limited to catering, ground transport, additional baggage, VIP lounge access, pets, de-icing, or special handling, are extra and charged separately.
3.3 Prices may be adjusted for:
(a) Changes in fuel costs;
(b) Airport or airspace fees;
(c) Additional passenger requests or itinerary changes.
3.4 Payment terms:
(a) Deposit requirements, balance due dates, and payment methods will be outlined in your booking confirmation;
(b) Non-payment or late payment may result in booking cancellation without liability;
(c) Refunds for partial or full cancellations are subject to operator terms.
4. Client Responsibilities
4.1 The Client must provide accurate and complete passenger information, including:
(a) Names and identification details;
(b) Passport, visa, or health documentation where required;
(c) Any special requirements (medical conditions, dietary requests, pets, etc.).
4.2 Clients are responsible for ensuring all passengers comply with all legal, immigration, and health requirements for departure, arrival, and transit points.
4.3 Clients must comply with operator instructions, including safety and security procedures.
4.4 The Client agrees to indemnify Air Porter International®and the operator for claims, fines, or costs arising from:
(a) Incorrect or incomplete passenger information;
(b) Non-compliance with travel regulations;
(c) Damage caused by passengers or their belongings.
5. Safety & Liability
5.1 All flights are conducted by licensed operators in full compliance with CASA regulations.
5.2 Air Porter International® acts solely as a broker. We are not responsible for:
(a) Aircraft operation or airworthiness;
(b) Flight delays or cancellations;
(c) In-flight incidents, including passenger injury or baggage loss.
5.3 Operators carry their own insurance covering passengers, aircraft, and third-party liabilities.
5.4 To the maximum extent permitted by law, we disclaim liability for:
(a) Direct, indirect, or consequential losses;
(b) Personal injury or death (except due to our gross negligence or willful misconduct).
5.5 Clients are responsible for any claims arising from breach of operator rules or unsafe behavior.
6. Cancellations & Changes
6.1 Cancellations must be submitted in writing. Refunds and fees are determined by the operator’s cancellation policy, which may include:
(a) Forfeiture of deposit;
(b) Partial refund depending on notice period.
6.2 Changes to passenger numbers, itinerary, or optional services after confirmation may incur additional charges.
6.3 If an operator cancels due to aircraft unavailability, maintenance, or other operational reasons, Air Porter International® will attempt to:
(a) Offer a suitable alternative aircraft;
(b) Adjust the itinerary to minimize disruption;
(c) Refund payments for the cancelled service if no alternative is acceptable.
6.4 Air Porter International® is not liable for delays or cancellations due to:
(a) Weather or airspace restrictions;
(b) Regulatory or governmental changes;
(c) Acts of God or force majeure events.
7. Optional Services & Special Requests
7.1 Optional services must be requested in advance and confirmed by Air Porter International®
7.2 Services may include:
(a) Catering and beverage service;
(b) Ground transportation or VIP transfers;
(c) Pet transport or special luggage handling;
(d) VIP lounge access or meet-and-greet services.
7.3 Charges for optional services are additional to the base Charter Price.
7.4 Empty leg or repositioning flights may be offered at discounted rates but are subject to operator approval and availability.
8. Privacy & Confidentiality
8.1 Personal and flight information is processed according to our Privacy Policy.
8.2 All booking details, pricing, and itineraries are confidential and may not be shared without consent, unless required by law.
9. Governing Law & Dispute Resolution
9.1 These Terms are governed by the laws of the State of Victoria, Australia.
9.2 Any disputes will be subject to the exclusive jurisdiction of the courts in the State of Victoria, Australia.
9.3 In the event of a dispute, parties agree to first attempt resolution via negotiation or mediation before pursuing legal action.
